WildRootHealth is a digital healthcare platform that facilitates connections between patients and holistic healthcare practitioners. We are not a healthcare provider but rather a technology platform that enables these connections.

  • Maya AI Matching: Intelligent practitioner-patient compatibility assessment
  • Directory Services: Searchable database of verified holistic practitioners
  • Profile Management: Tools for practitioners to manage their professional profiles
  • Secure Messaging: HIPAA-level encrypted communication between users
  • Educational Resources: Health and wellness content from verified sources
  • Location Services: Geographic matching and mapping functionality

2.2 Service Limitations

  • We do not provide medical advice, diagnosis, or treatment
  • We do not employ or directly supervise healthcare practitioners
  • We do not guarantee treatment outcomes or practitioner performance
  • Emergency medical services are not available through our platform

3. User Accounts

3.1 Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

3.2 Account Types

We offer two types of accounts:

  • Patient Accounts: For individuals seeking holistic healthcare
  • Practitioner Accounts: For licensed healthcare professionals

4. User Responsibilities

You agree to use our services in compliance with all applicable laws and regulations. You will not:

  • Provide false or misleading information
  • Impersonate another person or entity
  • Use the platform for any illegal or unauthorized purpose
  • Interfere with or disrupt the platform's functionality
  • Attempt to gain unauthorized access to any part of the platform
  • Upload or transmit viruses or malicious code
  • Engage in any activity that could harm or defame others

5. Healthcare and Medical Disclaimers

CRITICAL MEDICAL DISCLAIMER

WildRootHealth IS NOT a medical service provider, healthcare facility, or currently a HIPAA covered entity. We are a connection platform that facilitates introductions between patients and independent healthcare practitioners by passing information directly without long-term storage of protected health information.

5.1 No Medical Advice or Treatment

You expressly acknowledge and agree that:

  • No Medical Advice: We do not provide medical advice, diagnosis, treatment recommendations, or clinical services
  • Educational Only: All content on our platform is for informational and educational purposes only
  • Professional Consultation Required: Always consult with qualified healthcare professionals for medical decisions
  • Independent Practitioners: All practitioners on our platform are independent contractors, not our employees
  • No Endorsements: Listing on our platform does not constitute our endorsement of any practitioner

5.2 Maya AI System Disclaimer

AI Matching Limitations:

Maya AI provides automated compatibility suggestions based on user preferences and practitioner profiles. These are technology-generated recommendations, not medical advice or professional endorsements.

  • AI recommendations are not medical diagnoses or treatment plans
  • Algorithm results should be reviewed by qualified healthcare professionals
  • We do not guarantee the accuracy or completeness of AI-generated matches
  • Users are solely responsible for evaluating and selecting practitioners

5.3 Emergency Situations

EMERGENCY NOTICE:

If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. DO NOT use this platform for emergency medical situations.

5.4 Practitioner Verification

  • We verify basic licensing information but do not guarantee practitioner competency
  • Users are responsible for independently verifying practitioner credentials
  • We do not monitor or supervise practitioner-patient interactions
  • Treatment outcomes and practitioner performance are not our responsibility

6. Intellectual Property

All content on WildRootHealth, including text, graphics, logos, and software, is the property of WildRootHealth or its licensors and is protected by intellectual property laws.

You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks or logos without authorization
  • Reverse engineer or attempt to extract source code
  • Create derivative works based on our platform

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Payment Terms and Platform Fees

8.1 Platform Access Fees

Certain premium services may require payment. By using paid services, you agree to:

  • Authorization: Authorize us to charge your designated payment method

8.2 Practitioner Payments

Important Note:

Payments to practitioners for medical services are handled directly between patients and practitioners. WildRootHealth does not process, collect, or facilitate payments for medical services.

8.3 Refund Policy

  • Platform Fees: Subscription fees may be refunded within 30 days if services are unused
  • Processing Fees: Third-party processing fees are non-refundable
  • Disputed Charges: Contact us within 60 days of billing for dispute resolution
  • Service Issues: Refunds may be provided for technical service failures

9. Disclaimers and Limitations of Liability

9.1 Service Disclaimers

IMPORTANT LEGAL NOTICE:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILDROOTHEALTH PROVIDES ITS SERVICES "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We specifically disclaim all warranties, including but not limited to:

  • ACCURACY: Completeness or accuracy of practitioner information
  • AVAILABILITY: Uninterrupted or error-free service operation
  • RESULTS: Any specific outcomes from using our platform
  • SECURITY: Absolute security of data transmission or storage
  • THIRD-PARTY CONTENT: Content provided by practitioners or other users

9.2 Liability Limitations

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • NO CONSEQUENTIAL DAMAGES: We shall not be liable for indirect, incidental, special, consequential, or punitive damages
  • DAMAGES CAP: Our total liability shall not exceed the amounts paid by you to us in the 12 months preceding the claim
  • NO MEDICAL LIABILITY: We are not liable for any medical outcomes, treatment results, or practitioner actions
  • THIRD-PARTY ACTIONS: We are not responsible for actions of practitioners, other users, or third-party services
  • DATA ISSUES: Limited liability for data loss, corruption, or unauthorized access despite security measures

9.3 Healthcare-Specific Limitations

Medical Liability Disclaimer:

WildRootHealth shall have no liability for any medical malpractice, treatment failures, misdiagnoses, or any other healthcare-related issues arising from practitioner-patient interactions.

9.4 State Law Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless WildRootHealth, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of our services or violation of these Terms.

11. Account Termination and Data Handling

11.1 Termination by WildRootHealth

We may suspend or terminate your account immediately if:

  • Terms Violation: You breach any provision of these Terms
  • Fraudulent Activity: We detect fraudulent, abusive, or illegal behavior
  • Safety Concerns: Your actions pose risks to other users or platform integrity
  • Inactivity: Your account remains inactive for more than 2 years
  • Legal Requirements: We are required by law or regulation to terminate access
  • Business Reasons: We discontinue services (with 60-day notice)

11.2 Termination by You

  • Account Deletion: You may delete your account at any time through your account settings
  • Contact Method: Email us at support@wildroothealth.com for assisted deletion
  • Immediate Effect: Termination takes effect immediately upon request
  • No Refunds: Prepaid fees are generally not refundable upon voluntary termination

11.3 Post-Termination Data Handling

Data Retention After Termination:

Upon account termination, we will handle your data according to our Privacy Policy and applicable legal requirements.

  • Personal Data: Deleted within 30 days unless legally required to retain
  • Health Information: Deleted within 90 days or as required by healthcare regulations
  • Communication Records: Retained for 3 years for legal compliance
  • Anonymized Analytics: May be retained indefinitely in anonymized form

11.4 Survival of Terms

The following sections survive termination: Payment obligations, Intellectual Property, Disclaimers, Liability Limitations, Indemnification, and Governing Law.

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

12.2 Dispute Resolution Process

Mandatory Dispute Resolution:

Before filing any legal action, parties must attempt to resolve disputes through our formal dispute resolution process.

Step 1: Direct Communication

  • Provide detailed description of the dispute
  • Allow 30 days for investigation and resolution attempt

Step 2: Mediation

  • If direct resolution fails, either party may request mediation
  • Mediation through American Arbitration Association (AAA)
  • Each party bears their own mediation costs

Step 3: Binding Arbitration

  • If mediation fails, disputes shall be resolved through binding arbitration
  • Arbitration conducted under AAA Commercial Arbitration Rules
  • Single arbitrator, located in California
  • Arbitrator's decision is final and binding

12.3 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, COLLECTIVE ACTIONS, OR OTHER REPRESENTATIVE PROCEEDINGS.

12.4 Jurisdiction and Venue

Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in San Francisco County, California.

13. Changes to Terms

  • Immediate Effect: Changes take effect upon posting

13.2 Your Options

15. Miscellaneous Provisions

These Terms, together with our Privacy Policy and any additional agreements for specific services, constitute the entire agreement between you and WildRootHealth.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

15.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

15.5 Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions.
